1. Introduction

Welcome to Lumiere Studios! These Terms and Conditions ("Terms") govern your use of our services and website, accessible at www.lumierestudiosmiami.com . By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our services.

Lumiere Studios, located at 2250 NW 2nd Ave, Wynwood, Miami, FL 33127, provides professional photography services, including but not limited to portrait photography, wedding photography, commercial photography, product photography, event photography, and studio rentals. We are committed to providing high-quality services and maintaining a positive and collaborative environment for all our clients.

2. Booking Terms

2.1. Session Bookings

All session bookings are subject to availability. To book a session, you must complete the booking process through our website or by contacting us directly at (305) 555-PHOT (7468) or [email protected]. A non-refundable deposit, typically 25% of the total session fee, is required to secure your booking. This deposit will be applied to the final balance.

Upon booking, you will receive a confirmation email detailing the date, time, location, and services booked. It is your responsibility to review this confirmation and notify us immediately of any discrepancies. We reserve the right to refuse or cancel any booking at our discretion.

2.2. Studio Rentals

Studio rentals are available on an hourly or daily basis. Rental rates are outlined on our Services page. Bookings for studio rentals require a signed rental agreement outlining the specific terms of use, including equipment usage, studio rules, and liability waivers. A security deposit may be required to cover potential damages to the studio or equipment.

Rental clients are responsible for setting up and dismantling their own equipment. The studio must be left in the same condition as it was found. Any damages or excessive cleaning required will be billed to the rental client.

3. Cancellation Policy

3.1. Session Cancellations by Client

If you need to cancel or reschedule your session, you must provide us with at least 72 hours' notice. Cancellations made with less than 72 hours' notice will result in the forfeiture of your deposit. Rescheduling is subject to availability. If you reschedule with less than 72 hours' notice, a rescheduling fee may apply.

In the event of a no-show without prior notice, the full session fee will be charged.

3.2. Session Cancellations by Lumiere Studios

In the unlikely event that Lumiere Studios needs to cancel your session due to unforeseen circumstances (e.g., photographer illness, studio maintenance, inclement weather), we will make every effort to reschedule your session at a mutually convenient time. If rescheduling is not possible, we will refund your deposit in full.

3.3. Studio Rental Cancellations

Cancellations for studio rentals must be made at least one week prior to the rental date to receive a full refund of the rental fee (excluding any security deposit). Cancellations made with less than one week's notice will result in a 50% cancellation fee. Cancellations made with less than 24 hours’ notice will result in forfeiture of the full rental fee.

4. Liability

4.1. Client Responsibility

You are responsible for your own safety and the safety of your guests while on the premises of Lumiere Studios. We are not liable for any injuries or damages sustained during your session or studio rental, except in cases of gross negligence on our part. Clients are responsible for ensuring their conduct is appropriate and respectful towards our staff and other clients. We reserve the right to terminate a session or rental if a client's conduct is deemed inappropriate or disruptive.

4.2. Equipment Responsibility

Clients renting studio space are responsible for the proper use and care of all equipment. Any damage to equipment caused by misuse or negligence will be the responsibility of the client and will be billed accordingly. A detailed inventory of equipment will be conducted before and after each rental to ensure all items are accounted for and in good working order. Do not attempt to repair equipment; notify Lumiere Studios staff immediately of any issues.

4.3. Limitation of Liability

To the fullest extent permitted by law, Lumiere Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use our services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our services; (d) any bugs, viruses, Trojan horses, or the like, which may be transmitted to or through our services by any third party; (e) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the services; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

5. Intellectual Property

5.1. Copyright Ownership

Lumiere Studios retains all copyright ownership of the photographs and other creative works produced during your session or studio rental. You are granted a limited, non-exclusive license to use the photographs for personal use, including sharing on social media and printing for display. 5.2. Model Release

By participating in a photography session at Lumiere Studios, you grant us the right to use your likeness in our portfolio, website, and promotional materials. If you do not wish to have your images used for promotional purposes, you must inform us in writing prior to your session. A model release form will be provided for your signature.

5.3. Client-Provided Content

If you provide us with any content (e.g., logos, images, text) for use in your session or rental, you warrant that you have the necessary rights and permissions to use that content and that it does not infringe upon the intellectual property rights of any third party. You agree to indemnify and hold Lumiere Studios harmless from any claims arising from the use of client-provided content.

6. Accessibility

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms shall be resolved in the state or federal courts located in Miami-Dade County, Florida.

8. Changes to Terms

Lumiere Studios reserves the right to modify these Terms at any time without prior notice. Your continued use of our services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any updates or changes.
